Terms of Service

These Terms of Service ("Terms") govern your access to and use of Orb & Order, developed and operated by Nexavision ("we", "us", or "our"). By downloading, installing, or playing the Game, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age (or the minimum age of digital consent in your country) to use the Game. By using the Game you confirm that you meet this requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate registration information and keep it current.
• You may not share, sell, or transfer your account to another person.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Virtual Currency & In-App Purchases

Orb & Order offers virtual currency ("Crystals") and other in-game items for purchase. Please note:

• All purchases are final and non-refundable except where required by applicable law.
• Virtual currency and items have no real-world monetary value and cannot be exchanged for cash.
• We may modify, suspend, or discontinue virtual currency or items at any time.
• If you delete your account, you forfeit any remaining virtual currency or items.
• Purchases are processed by Apple (App Store) or Google (Google Play) per their respective terms.

4. Acceptable Use

You agree not to:

• Use cheats, exploits, automation software, bots, hacks, or any unauthorised third-party software.
• Modify the Game client or attempt to interfere with Game servers.
• Use the Game for any commercial purpose without our written consent.
• Harass, threaten, or abuse other players.
• Attempt to gain unauthorised access to any account, server, or network.
• Create more than one account to gain an unfair advantage.
• Engage in any conduct that disrupts the integrity or fair play of the Game.

5. Intellectual Property

All content in the Game — including artwork, audio, characters, code, game mechanics, text, and the Orb — is owned by Nexavision or its licensors and is protected by intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to play the Game for personal, non-commercial use only. You may not reproduce, distribute, or create derivative works without our prior written consent.

6. User Content

If the Game allows you to submit usernames, profile images, or other content, you grant us a worldwide, royalty-free licence to use, display, and distribute that content in connection with the Game. You represent that you have the right to grant this licence and that your content does not violate any third-party rights or applicable laws.

7. Disclaimers

The Game is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Game will be uninterrupted, error-free, or free of viruses. Devotion Points, prophecies, and follower counts are entirely fictional and carry no real-world significance whatsoever.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Nexavision and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Game. In no event will our total liability to you exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) AUD $100.

9. Termination

We may suspend or terminate your access to the Game at any time, with or without notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the Game ceases immediately and any remaining virtual currency or items are forfeited. You may stop using the Game at any time.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, unless otherwise required by consumer protection laws in your jurisdiction.

11. Changes to These Terms

We may update these Terms periodically. We will notify you of material changes via in-game notice or email at least 14 days before changes take effect. Continued use of the Game after changes take effect constitutes acceptance of the updated Terms.
